Terms & Conditions of Sale

These Terms & Conditions of Sale (“Terms”) govern the sale of all products by Javasticks (“Javasticks,” “we,” “us,” or “our”) to the purchaser (“customer,” “you,” or “your”). Your use of javasticks.com (the “Website”) is also governed by our Terms of Use and our Privacy Policy.
1. Governing Terms
These Terms apply to every order and supersede any prior understanding. Any additional or conflicting terms contained in a purchase order or other document issued by the buyer are rejected and shall have no effect unless expressly agreed to in writing by an authorized representative of Javasticks. Placing an order through this Website, accepting delivery, or making payment constitutes acceptance of these Terms.
2. Orders & Fulfillment
Payment in full is required at checkout. Orders typically ship within two (2) business days of purchase; weekends and holidays are not included. If an ordered item is temporarily out of stock, we will backorder it automatically without charging you and notify you of timing. Fulfillment and shipping timelines are estimates only and are not guaranteed. All orders are subject to our acceptance, and we may cancel or place an order on hold at our discretion, including for security verification where information appears fraudulent or incomplete.
3. Payment
We accept payment by credit or debit card at checkout — cards are the only payment method we take; checks and money orders aren't accepted. We do not add any card-processing fee: the price shown in your cart, plus applicable taxes, is the amount charged. If a payment is reversed or charged back, you agree to pay a $50 administrative fee plus any third-party fees we incur. All prices are exclusive of applicable sales, use, and other taxes, which are your responsibility. If you are exempt, you must provide a valid resale or exemption certificate before the order is placed.
4. Shipping & Delivery
We ship to United States addresses only — we do not accept or fulfill international orders. Shipping is free on every order. Orders ship as parcels via a carrier we select, and we may use split shipments or upgraded shipping at our discretion at no additional cost. Risk of loss transfers to the carrier once goods leave our facility. We are not responsible for carrier delays, or for packages recorded by the carrier as delivered. If a shipment is undeliverable or refused, or is returned due to an incorrect address you supplied, any reshipment costs are your responsibility and our actual shipping cost may be deducted from any refund.
5. Returns, Refunds & Cancellations
Our full policy is set out on the Returns & Refunds page and forms part of these Terms. In short: we offer a money-back guarantee for quality issues; incorrectly shipped or missing items are credited or resent; cancellations are accepted before shipment; we do not accept exchanges; and because our products are food items, returned product must be unopened in its original sealed packaging. Shipping damage may need to be claimed with the carrier, and we will assist you.
6. Food Product Notice & Assumption of Risk
Everything we sell is a consumable food product. Nutrition information is published for each product. If you need ingredient or allergen information, contact us at hello@javasticks.com before you order. It is up to you — not us — to check for allergens, sensitivities, caffeine content, and anything else your diet requires you to avoid, before you order and again before you brew. Nothing on this Website is nutritional, dietary, or medical advice; if you are unsure whether a product suits you, ask your physician before consuming it.
A stick's job is a good cup, but the cup is partly yours to make. Strength, color, aroma, and taste will vary with your water, its temperature, your cup size, how long you stir, and the batch-to-batch and harvest-to-harvest variation that comes with real tea and coffee. That variation is an inherent characteristic of agricultural products, not a defect, and no particular brew result is promised or warranted. Preparation involves hot water — use ordinary care.
After delivery, freshness is in your hands: keep sticks sealed, dry, at room temperature, and away from heat and direct sunlight, and use sound judgment about product that has been stored improperly or kept past its prime. By placing an order, you acknowledge these characteristics of consumable goods and knowingly and voluntarily take on every risk that comes with choosing, storing, preparing, and consuming our products, including whether any product is suitable for your own dietary needs. This assumption of risk runs in favor of Javasticks and each of the parties described in Section 9 (Affiliate Protection).
7. Receiving & Damage Claims
Inspect your shipment on delivery. If any item arrives damaged, photograph the damage and the packaging and report it to us in writing at hello@javasticks.com within two (2) business days of delivery. Retain all original packaging and contents, as they may be required for a carrier claim. No product may be returned without prior written authorization from Javasticks.
8. Limitation of Liability
To the fullest extent permitted by law, Javasticks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits and third-party costs. To the fullest extent permitted by law, our total liability for any claim relating to a product shall be limited solely to replacement of the product or refund of the purchase price, at Javasticks' sole discretion. The remedies stated herein are the customer's exclusive remedies.
9. Affiliate Protection
The limitations, disclaimers, and protections in these Terms apply equally to Javasticks and to its owners, members, managers, officers, employees, agents, and affiliates, each of whom may rely on and enforce these Terms.
10. Warranty Disclaimer
EXCEPT AS EXPRESSLY STATED IN THESE TERMS & CONDITIONS, ALL PRODUCTS ARE PROVIDED “AS IS.” JAVASTICKS MAKES NO WARRANTY, EXPRESS OR IMPLIED, AND EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Force Majeure
Javasticks is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including: ingredient or material shortages; supplier delays; labor disruptions; equipment failures; transportation interruptions; natural disasters, fire, flood, or severe weather; governmental actions, orders, or regulations; trade restrictions, tariffs, sanctions, or embargoes; epidemics, pandemics, or public health emergencies; cyber incidents or telecommunications failures; and acts of war, terrorism, civil unrest, or sabotage.
12. Governing Law, Venue & Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or any related transaction shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and the parties consent to the personal jurisdiction and venue of those courts. EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY. In any action to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs. Any claim arising from or relating to these Terms & Conditions or any related transaction must be brought within one (1) year after the cause of action accrues, or it is permanently barred.
13. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full force and effect (severability). Our failure to enforce any provision is not a waiver of that or any other provision (waiver). You may not assign your rights or obligations under these Terms without our prior written consent; we may assign freely (assignment). Notices to Javasticks must be sent to hello@javasticks.com (notices). The version of these Terms in effect at the time your order is placed governs that order, and we may amend these Terms from time to time (amendment). Headings are for convenience only and do not affect interpretation (headings).
